AccidentPal Terms of Service
These terms are the agreement between you and AccidentPal, Inc. for use of the AccidentPal mobile app, our web portal, and these public pages. Please read them. By creating an account or continuing to use the service, you accept them.
Who can use AccidentPal
You must be 18 or older to use AccidentPal. The service is offered in the United States. You agree to give accurate information, to keep your login credentials secure, and to be responsible for activity on your account.
What the service does
For drivers, the app helps you document an accident, keep your evidence in one place, see law firms that serve the area where the accident happened, choose one, and communicate with the firm that takes your case.
For law firms, the web portal presents cases from drivers in the areas a firm serves and provides the tools to accept and work them.
We are not a law firm
AccidentPal is not a law firm, does not practice law, and does not provide legal advice. We introduce drivers to independent law firms; we do not represent you and we do not supervise the firms listed.
Selecting a firm in the app does not create an attorney-client relationship. Whether a firm takes your case, on what terms, and when that relationship begins are matters between you and that firm. We do not guarantee that any firm will accept your case, that a firm will be available in your area, how quickly a firm will respond, or any outcome.
Emergencies
If anyone is injured or in danger, call 911. AccidentPal is not an emergency service and must never be used in place of one. Do not delay calling 911 or seeking medical care in order to use this app.
AccidentPal AI
The app includes an assistant that answers questions about what to do after an accident. Its responses are generated automatically and can be incomplete or wrong. They are general information only — not legal advice and not medical advice.
Do not rely on the assistant for an urgent decision, and never let it delay care or a call to 911. If a response looks harmful or wrong, use Report response so our team can review it.
Your content
You keep ownership of the photos, descriptions, messages, and other content you submit. You grant us the permission we need to operate the service: to store your content, to display it back to you, and to make it available to the law firm handling your case.
You are responsible for what you submit. Only upload evidence you have the right to share, and do not alter or fabricate evidence. Remember that photographs of an accident may show other people, vehicles, and documents.
Prohibited conduct
You agree not to use the service to:
- threaten, harass, or abuse another person;
- send sexual or otherwise inappropriate content;
- commit fraud, send spam, or misrepresent an accident or a claim;
- impersonate another person or a law firm;
- publish someone else’s personal information without a lawful reason;
- upload altered or fabricated evidence;
- break the law or infringe someone else’s rights;
- interfere with the service, probe its security, or try to reach data that is not yours.
Reporting, blocking, and enforcement
You can report a message, a conversation, a participant, or an assistant response, and you can block the other participant on your case. Blocking stops new messages on that case for both sides while preserving the existing record, because your report and evidence may still matter to your claim.
Our moderation team reviews reports. Depending on what we find, we may take no action, warn an account, restrict features, suspend an account, or terminate it. We may preserve content related to a report for as long as we need it to investigate or to meet a legal obligation. If we terminate your account and you believe we made a mistake, contact us.
Price
The AccidentPal app is free for drivers and contains no advertising. We never ask a driver to pay us for an introduction to a law firm. Law firms pay us under separate commercial terms; those charges happen in the web portal, not in the driver app.
Privacy and deleting your account
Our handling of your information is described in the Privacy Policy at https://app.accidentpal.ai/privacy, which is part of these terms.
You can ask us to delete your account at any time, from Settings in the app or from https://app.accidentpal.ai/delete-account. Deleting your account does not erase records we have a documented legal reason to keep, such as financial records or information subject to a legal hold; the Privacy Policy explains these exceptions.
Our intellectual property
The AccidentPal name, logo, software, and the design of the service belong to us, and these terms do not transfer any of those rights to you. If you send us feedback or a suggestion, we may use it without owing you anything for it.
Availability and third-party services
We work to keep the service available, but we do not promise it will be uninterrupted or error-free. We may change, suspend, or discontinue features. The service depends on third parties — including hosting, authentication, mapping, email, payment, and AI providers — and an interruption at one of them can interrupt the service.
Disclaimers and limits on our liability
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty about the conduct, competence, or availability of any law firm listed, or about the accuracy of assistant responses.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or the loss of a legal claim or its value. Some jurisdictions do not allow certain limitations, in which case those limitations do not apply to you.
You agree to indemnify and hold us harmless from claims and costs arising out of content you submit, your use of the service, or your violation of these terms or of the law.
Changes to these terms
We may update these terms. When a change is material, we will publish a new version with a new effective date and ask you to accept it before you continue using features that depend on it. If you do not accept the new version, you can stop using the service and delete your account.
